Terms of Service

1. Acceptance of Terms

By creating an account or using the TinyMiles mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms form a legally binding agreement between you and TinyMiles ("we," "our," or "us").

2. Eligibility

You must be at least 18 years old to create an account or use TinyMiles. By creating an account, you represent and warrant that you are 18 years of age or older.

TinyMiles is intended for use by adult caregivers. It is not designed for, marketed to, or permitted to be used by children under 18.

3. NOT MEDICAL ADVICE — IMPORTANT DISCLAIMER

We expressly disclaim any liability arising from your reliance on App content for medical purposes.

4. Your Account

Account responsibility: You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account.

Caregiver sharing: You may invite other adult caregivers to access your babies' data. You are responsible for the caregivers you invite and their use of the App.

Accurate information: You agree to provide accurate information when creating baby profiles and logging data.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to other users' data
• Reverse engineer, decompile, or modify the App
• Use the App to store or share content that is illegal, harmful, or violates others' rights
• Impersonate any person or entity

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.

You own your data. We use it only to provide and operate the App. We do not sell your data.

7. Intellectual Property

All App content, design, graphics, code, and trademarks are owned by or licensed to TinyMiles. You may not copy, reproduce, distribute, or create derivative works without our written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure, or that any data stored will be preserved without loss.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINYMILES AND ITS OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data
• Personal injury or harm arising from reliance on App content
• Medical decisions made based on App information
• Any damages exceeding the amount you paid to us in the 12 months preceding the claim (or $10 USD if you have not paid anything)

10. Indemnification

You agree to indemnify and hold harmless TinyMiles and its officers, employees, and licensors from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or any false or inaccurate data you enter into the App.

11. Account Deletion and Termination

You may delete your account at any time via Settings → Delete Account. Upon deletion, all your data will be permanently deleted in accordance with our Privacy Policy.

We may terminate your account if you violate these Terms, with or without notice.

12. Changes to Terms

If we make material changes, we will notify you via in-app notification and/or email at least 14 days before changes take effect. Continued use of the App after that date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
